1) Who is covered by DOT drug testing rules?

DOT testing covers safety-sensitive transportation employees and the companies and service agents that support testing. Procedures live in 49 CFR Part 40; modal agencies (FMCSA, FAA, FRA, FTA, PHMSA, USCG) set who is covered in their own rules.

2) What is in the DOT 5-panel?

Marijuana (THC), Cocaine, Amphetamines (including methamphetamine; MDMA analytes), Opioids (codeine, morphine, 6-AM for heroin; plus hydrocodone, hydromorphone, oxycodone, oxymorphone), and PCP.

3) Is oral fluid testing available now?

DOT authorized oral fluid in 2023, but employers can use it only when there are at least two HHS-certified oral-fluid labs listed by ODAPC. Until then, DOT drug testing remains urine (with modal exceptions such as FRA post-accident protocols).

4) When are DOT tests required?

Pre-employment (drugs), random, post-accident, reasonable suspicion/for-cause, return-to-duty, and follow-up, pursuant to Part 40 and the applicable modal rules.

5) What counts as a refusal to test?

Failing to appear, leaving early, failing to provide a specimen (without a valid medical explanation), adulterating or substituting, not permitting observed/monitored collections when directed, and other behaviors listed in 40.191 (drugs) and 40.261 (alcohol).

6) What happens after a positive or refusal?

Immediate removal from safety-sensitive duties and completion of the DOT return-to-duty process with a qualified SAP (negative RTD test + follow-up plan).

7) Is medical or recreational marijuana permitted? What about CBD?

No. DOT does not authorize marijuana use for any reason. CBD may contain THC or be mislabeled; safety-sensitive employees use it at their own risk.

8) What are the 2025 random testing rates?

Per ODAPC:

  • FMCSA: 50% drugs / 10% alcohol
  • FAA: 25% / 10%
  • FRA: 25% drugs / 10% alcohol for Covered Service & MOW; Mechanical 50% / 25%
  • FTA: 50% / 10%
  • PHMSA: 50% drugs (no random alcohol)

9) Who may collect DOT specimens?

Collectors who meet Part 40 Subpart C and follow the DOT Urine Specimen Collection Guidelines (current edition) and applicable modal rules.

10) What do the lab and MRO do?

HHS-certified labs test specimens per Subpart F; the MRO (licensed physician) independently reviews and verifies results and medical explanations under Subpart G.

11) What official forms/devices are used?

Drug testing uses the Federal CCF; alcohol testing uses approved devices and the ATF as specified by Part 40 and device lists.

12) What must FMCSA employers do in the Clearinghouse?

Register, run full pre-employment queries and annual queries, report violations/refusals, and record negative RTD and follow-up completion for CDL/CLP drivers.

13) Do drivers have to register for the Clearinghouse?

Drivers must register to give electronic consent for full (including pre-employment) queries and to view their records; otherwise registration is not automatic.

14) Can employees use hemp/CBD products?

DOT cautions that CBD use may still lead to a positive THC test; employees should exercise caution.
