Why is a DOT Consortium Required?

Owner Operators- DOT requires all owner-operators to enroll in a consortium so they are included in a compliant random testing pool because they cannot randomly test themselves.

Small Employers-Some smaller companies may not have enough drivers or safety-sensitive employees to maintain their own statistically valid random pool. Therefore, by joining a consortium, they are combined with other companies to form a large pool that meets DOT testing requirements.

Large Employers-Larger fleets may manage their own random pool but often use a consortium/TPA to outsource the process, reduce administrative burden, and ensure strict compliance.

Agency Coverage & Current Minimum Random Rates

Percentages are set by each DOT agency and may change.

FMCSA: Federal Motor Carrier Safety Administration

  • In compliance with 49 CFR Â382.305, employers must sustain a random testing program that adheres to federal standards. Owner-operators are required to be part of a consortium with at least two covered employees.
  • This ensures that 50% of the testing involves Controlled Substances using a DOT 5-panel urine test, while 10% pertains to DOT Breath Alcohol Testing (BAT). These regulations are crucial not only nationwide but especially in Virginia, where road safety and regulations are diligently enforced.

USCG: United States Coast Guard (now under homeland security)

  • Marine employers governed by 46 CFR Part 16.230 are obligated to execute random drug tests for crewmembers involved in safety-sensitive operations. In the state of Virginia, with its extensive maritime activities, adherence to these guidelines is critical for ensuring marine safety and integrity.
  • 50% of testing covers Controlled Substances through a DOT 5-panel urine test. Unlike DOT protocols for land transport, alcohol testing is not mandated within USCG's random testing criteria.

FAA: Federal Aviation Administration

  • Employers under 14 CFR Part 120 are required to integrate all safety-sensitive positions within their testing framework. This encompasses 25% of Controlled Substances testing through a DOT 5-panel urine test, coupled with 10% breath alcohol testing (BAT).
  • Complying with these stringent measures is vital in Virginia, where aviation safety is paramount to supporting both regional and international flight operations.

Virginia's rail infrastructure highlights the significance of such compliance, ensuring that safety protocols are maintained across all operational facets.

DOT Consortium: Frequently Asked Questions

What is a DOT Consortium (C/TPA) and who needs it?

  • A consortium C/TPA is responsible for the administration of part or all of an employer's drug and alcohol testing program, encompassing random testing pools and other compliance activities as mandated by 49 CFR part 40.

Are random testing percentages always the same or do they change?

  • Random testing rates set by the DOT can fluctuate yearly according to the positivity rate. However, in our consortium, regardless of these variations, all fees for DOT random testing are covered.

What happens when I am selected for a random test?

  • If chosen for a random test, ADT will alert the company's DER or owner-operator via email or phone, providing the nearest test site and necessary guidance. The selected individual must report to the testing location immediately upon notification.

What drugs are tested on a DOT drug test?

  • A DOT drug test includes a DOT 5 panel urine analysis and a DOT breath alcohol test. It is essential to ensure that these tests are conducted on a Federal CCF and a Federal Alcohol Testing Form.

Can you help during a DOT audit or inspection?

  • Absolutely, ADT can assist by compiling necessary documentation such as pre-employment tests, proof of random pool participation, supervisory training certificates, DOT policy development, and MIS reports.

How often can I update my employee pool?

  • Employee pool updates are confirmed quarterly, and employers have the flexibility to add or remove covered employees at any time before selection dates.
